The regular bi-monthly meeting of the President and Board of Trustees of the Village of Lakemoor was held on Thursday, July 10, 2008 in the Council Room at 234 West Rand Road, Lakemoor, Illinois.

 

The meeting opened at 7:08 p.m.

Approval of Purchase Orders

 

Motion by Trustee Beach, second by Trustee Koehl to approve the purchase order for Brien Madsen in the amount of $900.00 for the removal and replacement of sidewalks at 28935 Pilgrims Pass, 28807 Pilgrims Pass and 32746 Innetowne Road and add it to the Bills Payables.

Approval of the Bill’s Payables

 

Trustee Koehl asked if Treasurer Kirkpatrick had receipts to support the miscellaneous items listed on page 9 under Petty Cash.

President’s Report

 

President Povidas passed around a copy of the latest newsletter Kirk Homes sent out to their homeowners. She thanked everyone for their involvement in the 4th of July parade and for the plaque that was presented to her and read the names of the liquor license renewals.

 

Attorney Update – Lisa Waggoner

 

Attorney Waggoner announced there is a Zoning Board of Appeals Meeting scheduled for Monday, July 14th at 7:00 p.m. The agenda items include 615 Rand Road/Sonday and 333 Wegner Road/Village of Lakemoor. The Sonday hearing will be continued because they need more time to work on the site plan.

 

 

 

President Povidas and Attorney Waggoner met with representatives from Centrum Properties, the developers for the proposed southeast corner of Route 120 and 12. They discussed the updates and progress, and indicated they hope to bring application documents in the fall and are working with prospective tenants.

 

In closing, Attorney Waggoner informed the Board Members she received an inquiry from a proposed developer for the property at the southwest corner of Darrell and Route 120.

Trustee Beach stated the parade was wonderful and complimented Colin, Terry and PJ on a job well done.

 

Trustee McIntyre

 

Due to the news reports regarding problems with the fireworks factories in China, the ports and earthquakes, Trustee McIntyre contacted Larry Brodin and was relieved to know the supplies for our fireworks display are in.

 

He handed out the preliminary Lakemoorfest flyer to the Board Members and gave an update on the food vendors, tents, possible location of the carnival employees, bus routes, parking, purchase of water from Sam’s Club, the sale of coke products and the donation of a Wii from Best Buy.

Requested an update on the Kanzler event. Attorney Waggoner reminded him that this would be discussed later in the meeting under “New Business”.

 

He stated he would like the Village to utilize the new copier in the Clerk’s office for newsletters and flyers instead of outsourcing and requested a cost analysis.

1. Approval Of Support Letter for Johnsburg Community Action

    Network.

 

Motion by Trustee Koehl, second by Trustee Lennon to authorize and direct the Village President to sign the letter of support for the Johnsburg Community Action Network.

New Business:

 

1. Maneval Rezoning Presentation

 

Attorney Jean Miller explained her client would like to rezone approximately five acres of land that is part of a larger parcel owned by Gordon Stade and amend the zoning to light industrial.

 

After a brief discussion, President Povidas polled the Board Members. Trustee Beach, Trustee McIntyre and Trustee Lennon had no objections. Trustee Koehl stated he was undetermined at this time.

 

2. LAPP Wegner Road Application Proposal from Baxter & Woodman

 

Motion by Trustee Koehl, second by Trustee Beach to authorize the application by Baxter & Woodman on behalf of the Village of Lakemoor, McHenry County Council of Mayors 2009 application for local agency payment preservation projects for Wegner Road/South Drive.

3. Liquor License Variances for Lake Petroleum, Inc. (BP Amoco)

 

Attorney Waggoner explained under our liquor license it requires that if it is operated by an individual, the individual be a resident of the Village. If it is operated by a corporation, the corporation must have a registered agent who is a resident of the Village. After questioning the owner, Timmy Kalayil it was determined the registered agent does not reside in the Village and a variance must be granted

Motion by Trustee Beach, second by Trustee McIntyre to accept the variance to allow the registered agent to not be a resident of the Village subject to the following conditions:

 

1. Village receipt of acceptable fingerprint/background search results.

2. The registered agent must be changed to Timmy J. Kalayil and he must modify

     the appropriate page of the liquor license application and resubmit to the

     Village. The registered agent on his current application is Cyriak Chandy.

4. Waiver of Permit Fee ($15.00) and Issuance of Class G Liquor         

     License, for Issuance of Amusement License for Carnival ($15.00)

     and Issuance of Raffle License ($10.00), all to the Village of

     Lakemoor for Lakemoorfest.

 

Motion by Trustee McIntyre, second by Trustee Beach to accept the Waiver of Permit Fee ($15.00) and Issuance of Class G Liquor License, for Issuance of Amusement License for Carnival ($15.00) and Issuance of Raffle License ($10.00), all to the Village of Lakemoor for Lakemoorfest.

5. Issuance of Fireworks Permit to the Village of Lakemoor for

     August 9, 2008 Display, pursuant to section 43.07 of the Village

     Municipal Code.

 

Motion by Trustee Koehl, second by Trustee McIntyre to issue to the Village of Lakemoor a fireworks permit for Lakemoorfest, for August 9th with a rain date of August 10th, and waive the fee.

6. Resolution for Temporary Road Closure.

 

Attorney Waggoner distributed a copy of an excerpt from the zoning map and reviewed the letter she sent to the event organizer strongly urging them to cancel or relocate the event.

She informed the Board that Chief Frasier has advised his officers if they see brochures or flyers with merchants to advise them to take them down because the event is not occurring. He is also contacting other departments to let them know back up may be needed.

 

Also, she received a phone call from an attorney regarding the Kanzler matter and getting things started. She sent him a letter telling him Mr. Kanzler owes the Village $15,000.00 so there wouldn’t be a lot of discussion about matters until he pays that.

 

Attorney Waggoner explained the Village will take the measures of closing the roads, giving notification to the residents in advance, patrolling the area 24 hours per day on the dates planned for the event, detours, marking the detours and allowing only local traffic through that area.

 

Motion by Trustee Beach, second by Trustee Koehl to approve Resolution 08-R-07, a Resolution concerning the temporary closure of roads in the Bay View Farms Subdivision.

7. Resolution to Close Route 120 for Fireworks Display,

     August 9, 2008.

 

Motion by Trustee Beach, second by Trustee McIntyre approve Resolution 08-R-08, a Resolution concerning the closure of Route 120 for a fireworks display, with a rain date of August 10, 2008.

8. Discussion & Approval of Surveillance System for Morrison Park

     and Heritage Park.

 

Motion by Trustee McIntyre, second by Trustee Beach to table this agenda item until more quotes are received.

9. Consideration of Perricone Special Use & Annexation Before the

     Village of Volo.

 

Attorney Waggoner distributed a map and explained the application is for entitlement to a fairly significant operation located on property that is partially in Volo but the largest part is located in the county. She feels McMaster Drake, the management company for “The Pines of Lakemoor” should be made aware of this application due to the proximity of the proposed compost pad. There is a hearing on July 17th before the Planning and Zoning Commission of the Village of Volo. Attorney Waggoner stated she is not an expert in this field and suggested the Village hire someone that is.

 

The direction from the Board was for Attorney Waggoner to draft a letter of objection to Volo objecting to the placement of the compost facility and contact the IEPA to inquire as to the process of approval if there is going to be a public hearing and asked to be noticed.

 

Motion by Trustee McIntyre, second by Trustee Lennon to approve the Village Attorney to draft a letter of objection and retain a professional consultant not to exceed $2,500.00.

Citizen Comment

 

Christian Ledbetter, 203 Highland Drive explained on June 10th his dog was attacked by a doberman during a walk. Due to the severity of injuries the dog sustained he chose to euthanize his pet. The owners of the doberman had installed an invisible fence that did not keep the dog contained on their property. Mr. Ledbetter stated he has called the Lakemoor Police Department several times and they have not been cooperative. He asked the Board to address the fact that there is no Ordinance regarding invisible fences. He and his family are concerned and scared someone else could be attacked by this doberman or other stray dogs that roam the neighborhood.

 

Sue Stanczak, Highland Drive stated she lives across the street from Mr. Ledbetter and she was there when the parents told the children their dog was attacked. She said it took the police department 45 minutes to respond to Mr. Ledbetter’s call and their actions since have been appalling. She asked how many domestic animals are allowed in each home and stated there is long grass on Venice. She would like their concerns addressed at the next Village Board Meeting.

 

 

 

 

John Zink, Wellington Drive stated someone from the Board should spent 5 minutes after the meeting with Mr. Ledbetter. He also thanked the Board for stopping the Kanzler event.
